Jharkhand — frequently asked
- Jharkhand — CNT & SPT Acts (tribal land restrictions) — what should a buyer check in Jharkhand?
- Check if the land is protected under the CNT Act (1908) or SPT Act (1949): Land held by tribals/adivasis in Jharkhand has severe transfer restrictions. Check the record-of-rights (khatian) classification on JharBhoomi before anything else. Confirm whether the seller is a Scheduled Tribe (adivasi): Tribal-held land generally cannot be sold to a non-tribal without the Deputy Commissioner's (DC) permission; in the Santhal Pargana area it is effectively barred. If DC permission is required, confirm it has actually been granted: Under the CNT Act a transfer beyond the same tribe/village needs the Deputy Commissioner's sanction (except for industry/mining under the 1996 amendment). In Santhal Pargana, confirm the 'right to transfer' is recorded in the record-of-rights: The SPT Act (1949) makes a transfer invalid unless this right is recorded. Santhal Pargana division = Dumka, Deoghar, Godda, Pakur, Sahibganj and Jamtara. Verify khatian, khesra and mutation status on JharBhoomi
- What documents should I check before buying property in Jharkhand?
- Verify the sale deed and full chain of title, an Encumbrance Certificate (13–30 years), mutation (dakhil-kharij) in the seller's name, property tax receipts, and — for flats/houses — the approved plan and Occupancy Certificate. Under-construction projects need a valid RERA registration.
- How many years of Encumbrance Certificate should I get in Jharkhand?
- Get an EC covering at least the last 13 years (30 years is safest) so any hidden mortgage, lien or double sale on the property is visible.
